Terms of Service
These Terms govern your use of the Mail Bender Stream Deck plugin ("Mail Bender," "the Software"), published by Mail Bender ("we," "us," "our"). By installing or using Mail Bender, you agree to these Terms. If you do not agree, do not install it.
1. License
On valid purchase via Elgato Marketplace, you receive a non-exclusive, non-transferable license to install and use Mail Bender on Windows PCs you own or control, for personal or internal business use. The license is perpetual for the purchased version and includes free updates within the same major version (1.x).
2. Restrictions
- Don't redistribute, resell, sublicense, or share the Software beyond your own use
- Don't reverse engineer, decompile, or disassemble it except where law prohibits that restriction
- Don't use it to violate Microsoft's terms, the Microsoft Graph API terms, or any law
- Don't use it to send unsolicited bulk email or for any abusive automation
- Don't remove or alter copyright notices or trademarks
3. Microsoft dependency
Mail Bender depends on Microsoft Graph and Microsoft Outlook. It is not affiliated with, endorsed by,
or sponsored by Microsoft. Microsoft, Outlook, Stream Deck, and other marks belong to their owners.
Some actions require a Microsoft 365 work/school subscription (labeled [365]). We are not
responsible for Microsoft changing, deprecating, or gating API behavior, and will ship updates where
reasonable but cannot guarantee uninterrupted compatibility.
4. Advanced & destructive actions
Mail Bender includes actions that permanently delete data, send messages without confirmation, or
perform irreversible mailbox operations — labeled [ADV]. You are responsible for
understanding what each action does before mapping it to a key. We are not liable for data
loss, accidental sends, or other consequences of advanced/destructive actions. Test against a
non-critical inbox first.
5. Refunds
Refunds are handled by Elgato Marketplace under their policy. We honor any Elgato-approved refund and do not process refunds directly outside the Marketplace.
6. Warranty disclaimer
MAIL BENDER IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED / ERROR-FREE OPERATION. YOU USE IT AT YOUR OWN RISK.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS OR LOST DATA). OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF WHAT YOU PAID FOR THE LICENSE OR ONE HUNDRED US DOLLARS ($100).
8. State-specific consumer protections
Nothing here limits non-waivable consumer rights under your jurisdiction's law, including:
- California — Civil Code §1542 and the Consumer Legal Remedies Act
- Washington — RCW 19.86 Consumer Protection Act
- New Jersey — Truth-in-Consumer Contract, Warranty and Notice Act (TCCWNA)
- Massachusetts — M.G.L. c. 93A
Where any such law conflicts with these Terms, the law prevails to the extent it cannot be waived.
9. Termination
These Terms apply while you use Mail Bender. We may terminate the license for material breach; on termination you must uninstall the Software. Disclaimers, liability limits, and governing-law provisions survive.
10. Governing law
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-laws principles, and the federal Uniform Commercial Code applies to the licensing transaction. Disputes are resolved in Wyoming state or federal courts, except where your home jurisdiction grants a non-waivable right to bring the dispute locally.
11. Severability & changes
If any provision is unenforceable, the rest remain in effect. We may update these Terms; the date above reflects the latest version, and material changes are noted at the top for at least 30 days.
